According to the General Port Regulations No. 38)

1. MANAGEMENT: The administration of the above vessel is assigned to Marinos Kyranas, holder of a license to operate motor yachts without navigation limit from the coast, issued by the Port Authority ……… with number ……… and valid until ……….
Different management of the vessel without the written consent of the OWNER is expressly excluded.

2. CONTRACT SIGNING TIMES: The charterer is authorized to sign this charter agreement and make related payments only after receiving written confirmation from the OWNER or via email from the manager, who reserves the right to evaluate the feasibility of the cruise, the availability of the vessel during the required period, as well as other logistical reasons.

3. NAVIGATION AREA: The navigation, which is defined herein as the cruise, is carried out exclusively in the Ionian Sea area, specifically as agreed upon by the parties …….. (you may specify further if known).

4. CRUISE PERIOD: Boarding on …/………/2018 at …….. a.m. at the dock/port ………..
Disembarkation on …/…./2018 at ….. at the dock/port ………..

5. AGREED PRICE AND PAYMENT METHOD: The price is agreed at ………………….(………….) EUROS. Payment must be made by depositing a 50% advance of the agreed price equal to ……(….) EUROS to be made at the time of booking and upon signing this charter agreement. The remaining 50% of the agreed price equal to ……..(……) EUROS must be deposited before the boarding date. In the event that the booking coincides with the day of the cruise, the total agreed fee must be prepaid before boarding the vessel.

6. AGREED PRICE INCLUSIONS: The agreed price includes the cost of chartering the vessel, the cost of final cleaning, the use of auxiliary engine (if available), the use of electrical power, inverter, port electronics, shading awnings, seats… (other features if applicable) and third-party liability insurance for transported persons. The price does not include fuel expenses for the vessel, port fees, and any other unspecified expenses.

7. TERMS AND GENERAL CONDITIONS:
A) OWNER’S OBLIGATIONS: The OWNER undertakes to make the vessel available to the charterer on the boarding date and deliver it in perfect working order, clean, in excellent navigational condition, equipped with all legally required safety equipment, and with a skipper who performs navigation and handling functions. The skipper shall ensure that each participant maintains proper behavior for the smooth operation of the cruise and complies with applicable rules.

B) WEATHER AND USE DISCLAIMER: The OWNER provides no warranty regarding the use and comfort of the vessel in case of bad weather within the selected navigation area. The skipper will make efforts to navigate the vessel safely to harbors and anchorages within the agreed route limits. The cruise program may vary at the skipper’s discretion based on weather conditions and other necessary nautical and docking techniques. The skipper may make decisions to ensure navigation safety and may alter the schedule and manner of reaching intended destinations if they are difficult, impossible, or unavailable. The charterer and participants cannot claim compensation for any damage or inconvenience caused by the described conditions. The charterer and participants acknowledge the risks involved in a vessel cruise. In case of an accident not caused by the skipper, the injured party cannot claim compensation and should consider personal accident insurance. In case of an accident caused by the skipper, the OWNER may claim compensation according to applicable regulations.

C) CHARTERER AND PARTICIPANTS’ OBLIGATIONS: The charterer and participants must inform the skipper before boarding of any health issues, allergies, mobility problems, or other peculiarities, or if they are unable to swim. They must accept any safety-related decisions made by the skipper, stay in their designated positions on the vessel, and wear life vests. The charterer and participants expressly agree not to engage in any form of trade, or transport weapons, explosives, or narcotics, even for personal use. Violations of applicable laws or regulations by the charterer or participants result in legal consequences, including potential arrest and compensation to the OWNER for any losses or damages. These incidents are sufficient cause for the OWNER to cancel the signed agreement and immediately disembark the responsible participant. The charterer and participants must board with small, foldable soft luggage for easy storage, containing only essentials. Each participant is solely responsible for their personal belongings, and in case of theft, loss, or damage, they bear the responsibility. The charterer and participants are liable for any damage to the vessel and its contents caused intentionally or negligently, or contrary to the skipper’s instructions. Smoking and consumption of food and drinks are prohibited (if applicable in closed spaces). Smokers must take necessary precautions to avoid damaging the vessel.

D) DAMAGES AND REPAIRS: In case of unexpected damages requiring immediate repair, the charterer and participants cannot claim a refund. However, the OWNER, considering the timing and remaining cruise period, may reschedule the cruise to another available date and time.

E) CANCELLATION BY OWNER: If the OWNER cancels for reasons of force majeure, personal reasons, health emergencies, etc., the charterer will be informed immediately and can choose from the following options: i) if the next scheduled charter permits and the OWNER agrees, the charter period may be extended for the delayed period; ii) keep the agreed charter end date and time with a refund for the delayed days or hours proportional to the total charter amount; iii) if the delay exceeds 1/4 of the total charter time, the agreement will be canceled and the total paid amount refunded. In any of these options, the charterer cannot claim compensation for loss or damage resulting from the charter cut or cancellation.

F) CANCELLATION BY CHARTERER: In case of cancellation by the charterer, they must inform the OWNER in writing immediately, providing booking details with a basic cancellation fee of 5% of the deposited amount. If cancellation is notified 60-45 days before boarding, 20% of the deposited amount is retained. If notified 44-30 days before boarding, 50% is retained. If notified 29-15 days before boarding, 70% is retained. For cancellations within 14 days before boarding, the total deposited amount is retained. Date changes are possible without charge, based on vessel availability.

1. JURISDICTION: For any matters not covered herein, applicable laws and regulations apply. Any disputes will be exclusively settled by the Courts of Igoumenitsa.

8. DATA PROTECTION: The data provided in this agreement are processed by the OWNER solely for charter and accounting purposes, in full compliance

The signing of this contract constitutes consent on the part of the charterer and in the name and on behalf of all the participants represented by him, declaring that he has full knowledge of his rights and obligations, as defined above and in particular declares responsibly that he has been informed and accepts the terms and policy of the joint venture company “IONION GATEWAY CRUISE O.E.”, which are part of this agreement, and declares that after being informed about the telecommunication equipment, the life-saving equipment, he checked all the areas of the vessel, which he inspected and it is to his liking of and in accordance with the applicable legislation, received the legal documents thereof and expressly consents and accepts the conclusion of this agreement.
